Terms of Service

Welcome to Lumera. By downloading, installing, or using the Lumera app ("App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use Lumera. By using the App, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

2. Description of Service

Lumera is a personal wardrobe and outfit-planning app. It allows you to:

• Add photos of your clothing to a digital wardrobe
• Get AI-powered outfit suggestions based on occasions and your style preferences
• Use virtual try-on to preview how items look together
• Save outfits for later

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with or without notice.

3. Account and Responsibilities

• You must sign in with Apple or Google to use the App. You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity under your account.
• You agree to provide accurate information and to update it as needed.
• You agree not to use the App for any unlawful purpose or in any way that could harm the App, other users, or third parties.

4. User Content

• You retain ownership of the photos and data you upload (wardrobe items, body photos, etc.).
• By uploading content, you grant us a limited license to store, process, and use it solely to provide and improve the service (e.g., AI classification, outfit generation, try-on). We will not use your content for advertising or sell it to third parties.
• You represent that you have the right to upload all content you provide and that it does not infringe any third-party rights.
• Do not upload content that is illegal, harmful, or inappropriate. We may remove content or suspend accounts that violate these Terms.

5. AI Features

Outfit suggestions and virtual try-on use AI (including Google Gemini). AI outputs are provided for inspiration only and may not always be accurate or suitable. You are responsible for your own style and wardrobe decisions.

6. Privacy

Your privacy matters. Our collection and use of data is described in our Privacy Policy. By using the App, you consent to that policy.

7. Intellectual Property

The App, including its design, code, branding, and features (excluding your content), is owned by us or our licensors. You may not copy, modify, distribute, or reverse-engineer the App without our prior written permission.

8. Disclaimers

The App is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose. We do not guarantee that the App will be uninterrupted, error-free, or secure. AI-generated results are not guaranteed to be accurate or appropriate.

9. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App.
• Our total liability for any claims relating to the App shall not exceed the amount you paid to us in the 12 months preceding the claim (or $0 if you have not paid).

Some jurisdictions do not allow these limitations; in such cases, our liability is limited to the maximum extent permitted by law.

10. Account Termination

• You may delete your account at any time from within the App (Profile → Delete Account). Upon deletion, we will remove your data as described in our Privacy Policy.
• We may suspend or terminate your access if you breach these Terms or for any other reason at our discretion.

11. Apple-Specific Terms

If you use Lumera on an Apple device:

• These Terms are between you and us, not Apple. Apple has no obligation to provide support for the App.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Apple has the right to enforce them against you.
• To the extent these Terms conflict with Apple's App Store Terms of Service, Apple's terms apply where required.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App or on our website. Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law and Disputes

These Terms are governed by applicable laws, without regard to conflict of law principles. Any disputes shall be resolved through good-faith negotiation between the parties.
